AMATEUR SPORTS PARTICIPATION
WAIVER AND RELEASE OF LIABILITY
All participants in the Chicago Indoor League must sign and submit the waiver below before playing in any of our leagues. If we do not have your waiver on file at game time, you will not be permitted to participate. Thank you for your cooperation and understanding.
By signing this Waiver and Release of Liability (Agreement), I waive and release FAYSA, LLC, its agents, servants, employees, insurers, successors and assigns from any and all claims, demands, causes of action, damages or suits at law and equity of any kind, including but not limited to claims for personal injury, property damage, medical expenses, loss of services, on account of or in any way related to or growing out of my presence or involvement at the facility.
This waiver and release is intended to and does release FAYSA, LLC from any and all liability for damages or injuries on account of or in any way related to or growing out of my negligence, the negligence of third parties and FAYSA, LLC’s negligence. This is not intended to release FAYSA, LLC from any liability resulting from their intentional conduct.
I further covenant and agree not to institute any claims or legal action against FAYSA, LLC for any claim released by this Agreement. I further agree that should any claim be made against FAYSA, LLC in contravention of this Agreement, including but not limited to derivative claims, I will protect, defend and completely indemnity (reimburse) FAYSA, LLC for any such claim and expenses including attorney’s fees and costs incurred by FAYSA, LLC in defending themselves or security indemnity hereunder.
I understand that FAYSA, LLC is not responsible for any lost, stolen, or damaged valuables or property.
I acknowledge that I have received and read a copy of the current rules and regulations governing the use of the facility. I agree that I will fully comply with all rules and regulations and with any amendments.
I have read the Agreement and understand that by signing the Agreement I have consented to be bound by its terms, including the waiver/release of any legal right I may have to sue FAYSA, LLC for any costs they incur because a claim or legal action is brought in violation of this Agreement. I agree any violation of the Agreement and its terms and conditions, as determined by FAYSA, LLC, will void and terminate this Agreement and may result in loss of the ability to use the facility.
I am signing this Agreement freely, voluntarily and competently and am at least eighteen (18) years of age.
COVID19 Waiver
Please review this Agreement carefully as we have updated it to include your authorization for a COVID-19 wellness screening, your assumption of risk for potential exposure to and resulting illness or injury from COVID-19, and your release and waiver of any related claims or liability for all involved parties including the Chicago Indoor League (FAYSA, LLC) and Lycée Français de Chicago (Lycée). We will also require all Participants and visitors to follow strict health and safety rules to reduce the spread of the COVID-19 virus. Because the CDC recommends that individuals with underlying medical conditions take extra precautions to reduce their higher risk of severe illness from COVID-19 (including those with lung, kidney, liver, or autoimmune diseases; serious heart conditions; obesity; diabetes; or asthma), we strongly encourage such Participants to consult with a doctor before participating in Activities with the Chicago Indoor League at the Lycée. COVID-19 is extremely contagious and no amount of safety precautions can eliminate the risk of exposure.
As consideration for being allowed to enter at the Lycée and participate in any activity, program, event, party or function with the Chicago Indoor League at the Lycée (including, without limitation, any soccer, volleyball or other athletic practice, game, training session, camp, or event (collectively, “Activities”), the undersigned (a) on his or her own behalf as Participant (if Participant is age 18 or older), or (b) on his or her own behalf and on behalf of Participant as Participant’s parent or legal guardian (if Participant is under age 18), hereby understands, acknowledges, and agrees as follows:
1. If Participant is under age 18, I am the parent or legal guardian of Participant.
2. I am physically fit and have no known medical conditions which prohibit my participation in Activities with the Chicago Indoor League at the Lycée. Should I become ill or injured on site, I authorize Chicago Indoor League's employees or agents to render medical assistance or treatment as needed at my cost.
3. I agree to follow all rules and regulations of the Chicago Indoor League and the Lycée from time to time in effect, including all Center COVID-19 health and safety guidelines. I authorize the Chicago Indoor League and the Lycée to conduct a COVID-19 wellness screening upon my entry including taking my body temperature.
4. I understand that the risk of injury from Activities with the Chicago Indoor League at the Lycée is significant, including, but not limited to, the potential for (1) minor injuries, such as cuts, bruises, muscle strains and sprains, (2) major injuries, such as broken or fractured bones, concussion or lost teeth, and (3) catastrophic injuries, such as heart attacks or fractured skull or those that cause disfigurement, loss of mental capacity, loss of sight, speech or hearing, paralysis or death. In addition, I acknowledge that, by participating in Activities with the Chicago Indoor League at the Lycée, I may be exposed to (i) potentially harmful or deadly disease, such as “severe acute respiratory syndrome coronavirus 2” (SARS-CoV-2) or coronavirus disease (COVID-19) and any mutations or variations thereof, influenza, common cold, chicken pox, meningitis or measles, (ii) infection, and (iii) carcinogens. I understand that if I have an underlying medical condition including lung, kidney, liver, or autoimmune disease, a serious heart condition, obesity, diabetes, or asthma, I am at higher risk for severe illness or health complications from this exposure to SARS-CoV-2 and COVID-19. I further understand that there is a significant risk of damage to my personal property from my participation in Activities with the Chicago Indoor League at the Lycée.
5. I WILLINGLY AND VOLUNTARILY ASSUME ALL RISKS in any way associated with, related to, or occurring as a result of, my participation in Activities with the Chicago Indoor League at the Lycée, however caused or arising, both known and unknown, EVEN IF SUCH RISKS ARISE FROM THE NEGLIGENCE or carelessness OF ANY RELEASED PARTY (as defined below) OR OTHERS.
6. I hereby forever release, hold harmless, waive, discharge and indemnify, and covenant not to sue, to the fullest extent permitted by law, the Lycée Français de Chicago, Chicago Indoor League and FAYSA LLC, and each of their respective predecessors, successors, affiliates, members, managers, partners, shareholders, and controlling and controlled persons (together with any and all directors, officers, employees, volunteers, independent contractors, trustees, representatives, attorneys, agents and assignees of each of the foregoing) (collectively, the “Released Parties” and, each of them, individually, a “Released Party”) from and against any and all liabilities, debts, obligations, costs, expenses, damages, judgments, liens, claims and demands of any nature or description, in equity or at law, that I (or my heirs, assigns, next of kin or personal representatives) may hereafter own, acquire or hold against any one or more of the Released Parties, known or unknown, suspected or unsuspected, asserted or not, arising out of my participation in Activities with the Chicago Indoor League at the Lycée, even if the risks and liabilities that I am releasing arise out of the negligence or carelessness of ANY RELEASED PARTY.
7. I grant each of the Released Parties permission to film, record or photograph me and the perpetual right to use my name, image, likeness and voice for any commercial or noncommercial purpose without any consideration or payment to me.
8. I consent to receive telemarketing calls and emails from the Released Parties for marketing purposes.
